The Airnova Distributor Program is operated by BluePeak DEV LLC ("Airnova," "we," "us," or "the Platform"). These Terms apply to every person or entity that applies for, registers for, or participates in the Program (a "Distributor").
These Terms form part of the Airnova Terms of Service. By creating a Distributor account, using Distributor features, sharing a promotional link or code, or earning commission, the Distributor confirms that it has read, understood, and accepted these Terms.
1. Program Description
The Program allows eligible Distributors to promote Airnova eSIM products and earn commission on qualifying purchases by validly attributed end customers. Commission is based on genuine customer transactions, not on recruiting other Distributors, purchasing a membership, or building a downline. No inventory or advance eSIM purchase is required. Participation is non-exclusive, and Airnova does not guarantee any minimum income, fixed return, or sales result.
2. Eligibility and Application
A Distributor must have legal capacity to contract and, when acting for an organization, proper authority. Registration information must be true, accurate, and complete. Airnova may require identity, business, tax, sanctions, payment, anti-fraud, or security verification and may reject, suspend, or terminate an account that is ineligible, misleading, high-risk, or non-compliant.
3. Distributor Account and Promotional Code
Each account may receive a unique invitation code or promotional link. The Distributor must protect credentials and may not sell, rent, transfer, or share the account with an unauthorized person. Custom codes must not infringe rights, impersonate Airnova, mislead users, or contain unlawful or inappropriate content. A code or link grants no ownership of Airnova trademarks, domains, social-media names, or other brand assets.
4. Customer Attribution
A customer generally must register through the Distributor's valid code or link. Each customer may be attributed to only one Distributor or other promotional relationship. Existing users or users with another valid attribution cannot be re-registered to change attribution. Attribution disputes are determined from Platform registration, account, payment, and transaction records, subject to a reasonable review channel.
5. Commission Categories
5.1 New-product commission
When an attributed customer purchases a particular Airnova catalog product for the first time, commission is calculated using the Distributor's applicable new-product rate. Different data amounts, durations, or variants under one catalog product may still be treated as the same product. New-product commission does not require repeat-purchase eligibility to be active.
5.2 Same-product repeat-purchase commission
A later purchase by the same customer of the same catalog product is a same-product repeat purchase. It earns repeat-purchase commission only while the Distributor's repeat-purchase eligibility is active. If eligibility is inactive or expired, the customer may still purchase, but no repeat-purchase commission is generated. A first purchase of a different catalog product remains subject to the new-product rule.
6. Standard Commission Tiers
The current standard tiers are:

Airnova may add or change future tiers, thresholds, and rates after reasonable publication. Valid, successfully attributed new-product and repeat-purchase orders may count toward tier progress. Under the standard program, tiers increase automatically and ordinarily do not decrease, although fraud, error, invalid orders, refunds, or rule circumvention may be corrected. A tier change applies prospectively and does not recalculate earlier commissions.
7. Repeat-Purchase Eligibility
Current standard activation conditions are:

Only newly attributed customers and valid USD orders that have completed payment, delivery, required activation or risk checks, and have not been cancelled, refunded, charged back, or classified as fraudulent count. A qualifying batch must include at least three different customers and satisfy both per-customer and combined thresholds. Once satisfied, eligibility is active for 60 days. Customers used for one qualifying batch cannot be reused for a later batch. A new qualifying batch resets the window from the new qualification time. Eligibility affects only orders completed after activation and does not retroactively create commission.
8. Commission Calculation
Commission is generally calculated from the qualifying product amount multiplied by the applicable rate. Taxes, payment fees, refunds, chargebacks, non-commissionable amounts, and non-product charges may be excluded. Platform-funded discounts ordinarily do not reduce the commission base. A discount funded by the Distributor may be deducted from the Distributor's commission and cannot create a negative commission. Platform accounting records control rounding, currency conversion, and final settlement.
9. Commission Status, Refunds, and Reversals
Commission may remain pending during delivery, fraud, refund, or chargeback review. A cancelled, refunded, charged-back, duplicate, fraudulent, or otherwise invalid transaction may result in cancellation, withholding, reversal, or recovery of commission. Airnova will maintain reasonable records, and the Distributor may request review through support.
10. Distributor Coupons
Where enabled, a Distributor may create coupons subject to Platform limits. The Distributor-funded discount may reduce otherwise payable commission. Coupons must not be misleading, unlawfully distributed, combined contrary to checkout rules, or used to create self-dealing, artificial transactions, or abuse.
11. Balance and Withdrawals
Commission shown in the Distributor account may be pending, available, frozen, reversed, or paid. Withdrawal is permitted only for available commission and is subject to minimum amounts, supported payment methods, verification, fees disclosed before withdrawal, tax obligations, sanctions screening, fraud review, and processing time. Platform credit, customer referral rewards, promotional credit, and other non-withdrawable balances do not become withdrawable commission merely because they appear in the same account interface.
12. Taxes and Records
The Distributor is responsible for determining and paying taxes arising from participation, except where Airnova is legally required to withhold, report, or remit. The Distributor must provide accurate tax and payment information and maintain legally required business and transaction records.
13. Marketing Rules
A Distributor must market lawfully, accurately, and transparently; clearly identify itself as an independent Distributor where appropriate; avoid false claims about coverage, speed, price, refunds, earnings, or network ownership; and comply with advertising, privacy, anti-spam, consumer-protection, and intellectual-property law. A Distributor may not impersonate Airnova, BluePeak DEV LLC, a mobile operator, or an employee; enter contracts or promise refunds for Airnova; bid on protected brand keywords; or register confusingly similar domains, applications, or social accounts without written permission.
14. Customer Relationship and Support
The customer purchases from Airnova under Airnova's applicable terms. The Distributor does not own the customer account, order, or personal information and must direct order, eSIM, payment, and refund issues to official Airnova support. The Distributor may not collect customer passwords, verification codes, complete payment-card data, or eSIM installation credentials.
15. Prohibited Conduct
Prohibited conduct includes self-referral, fake or duplicate accounts, fabricated orders, circular payments, unauthorized payment methods, automated registration, attribution manipulation, coupon or commission abuse, spam, harassment, unlawful advertising, privacy violations, resale outside permitted channels, chargeback manipulation, disclosure of confidential information, interference with the Platform, and any attempt to evade Program controls.
16. Review, Suspension, and Termination
Airnova may review suspicious activity, request verification, hold settlement, limit features, reverse invalid commission, suspend participation, or terminate an account where reasonably necessary for compliance, security, fraud prevention, or enforcement. Serious fraud or unlawful activity may be reported to payment providers or authorities. A Distributor may request review of a decision through support.
17. Independent Relationship
The Distributor is an independent participant and not an employee, agent, partner, franchisee, fiduciary, or legal representative of Airnova or BluePeak DEV LLC. The Distributor has no authority to bind Airnova, collect money on its behalf, sign agreements, make warranties, or accept legal notices for Airnova.
18. Intellectual Property
Airnova names, trademarks, software, pages, designs, images, copy, and other materials belong to BluePeak DEV LLC or the applicable rights holder. Any permitted brand materials are licensed on a limited, revocable, non-exclusive, non-transferable basis solely for compliant Program promotion. No ownership is transferred.
19. Confidentiality and Data Protection
Non-public commercial, technical, commission, customer, security, and operational information must be kept confidential and used only for authorized Program purposes. Each party must comply with applicable privacy and data-protection law. The Distributor may process only the minimum customer information lawfully obtained and must protect it against unauthorized access or disclosure.
20. Liability and Indemnity
To the extent permitted by law, each party is responsible for losses caused by its own breach, negligence, fraud, or unlawful conduct. The Distributor must indemnify BluePeak DEV LLC and Airnova against third-party claims, penalties, and reasonable costs arising from the Distributor's unlawful marketing, false statements, privacy violations, infringement, tax failure, or breach of these Terms. Mandatory rights and liabilities that cannot legally be limited remain unaffected.
21. Program Changes
Airnova may modify future commission rates, thresholds, eligibility conditions, product scope, payment methods, or other Program rules for legal, fraud, operational, or commercial reasons. Material changes will be published through the website, application, Distributor center, email, or another reasonable channel with an applicable date. Confirmed valid commission will not be cancelled merely because future rules change.
22. Governing Law and Disputes
The governing-law and dispute provisions of the Airnova Terms of Service apply unless mandatory law requires otherwise. Before formal proceedings, the parties should attempt in good faith to resolve a dispute through Airnova support.
